Welcome to Rize. These Terms of Use ("Terms") govern your use of the Rize mobile application (the "App"), developed by Riley Palattao ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of the Service

Rize is a morning alarm clock app designed to help you wake up and start your day with purpose. To dismiss an alarm, you must complete a mission such as performing pushups, taking a photo, reading a bible verse aloud, saying an affirmation, or finding an object. The App uses your device camera and microphone along with AI-powered verification to confirm mission completion.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use the App.

3. Account Creation and Security

To use the App, you must create an account using Sign in with Apple or Sign in with Google. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the App only for its intended purpose and in compliance with all applicable laws. You agree not to:

• Use the App for any unlawful or fraudulent purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or infrastructure
• Submit inappropriate, offensive, or harmful content through photo or audio missions
• Attempt to circumvent mission verification or alarm dismissal mechanisms
• Use the App to harass, abuse, or harm others
• Create multiple accounts or use automated tools to interact with the App

5. In-App Purchases and Subscriptions

Rize may offer premium features through auto-renewable subscriptions or one-time in-app purchases. By making a purchase:

• Payment is processed by Apple through the App Store. We do not collect or store your payment information.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions through your Apple ID account settings.
• Refunds are handled by Apple in accordance with their App Store Terms.
• Prices may change with notice. Continued use after a price change constitutes acceptance.

6. Camera, Microphone, and AI Processing

Certain missions require access to your device's camera or microphone. By using these features, you acknowledge that:

• Photos and audio recordings may be sent to Google Gemini AI for mission verification
• Media is processed for verification purposes only and is not stored permanently
• You are responsible for the content you capture during missions
• You grant us permission to process your media through our AI verification services

7. Intellectual Property

The App, including its design, code, features, content, graphics, and trademarks, is owned by Riley Palattao and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App or its content
• Use the Rize name, logo, or branding without written permission
• Create derivative works based on the App

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Alarms will always trigger reliably (device settings, battery optimization, and system limitations may affect alarm delivery)
• AI-powered mission verification will always be accurate
• The App will be compatible with all devices or operating system versions

9. Limitation of Liability

To the maximum extent permitted by applicable law, Riley Palattao shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability exceed the amount you paid for the App or any in-app purchases in the twelve (12) months preceding the claim.

You acknowledge that the App is an alarm clock tool and we are not liable for any consequences of missed alarms, including but not limited to being late for work, missing appointments, or any related damages.

10. Indemnification

You agree to indemnify and hold harmless Riley Palattao from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App and delete your account at any time. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be resolved in the courts located in the State of California.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Riley Palattao regarding your use of the App.
